Cameron County arrest records are important criminal justice documents that provide information about an individual's interactions with law enforcement agencies. These records promote government transparency by allowing the public to review and evaluate law enforcement agencies' actions, such as arrests, to determine whether they were conducted in accordance with applicable laws. They are also a key component of criminal history record information (CHRI) compiled by the Texas Department of Public Safety (DPS) for individuals. Generally, the Texas Public Information Act controls the release of arrest records, while Chapter 66 of the Texas Code of Criminal Procedure governs CHRI releases. 

Are Arrest Records Public Information in Cameron, Texas?

The Texas Public Information Act (PIA) deems arrest records in Cameron County public information. As a result, anyone may access these records by querying their respective custodians. However, the PIA permits record custodians to restrict public access to arrest records in certain situations. These include, but are not limited to, records connected to an ongoing investigation or criminal case, sealed or expunged records, and juvenile offender records.  

Cameron County Arrest Search

One way interested persons may find Cameron County arrest information is by conducting a statewide criminal history record information (CHRI) check through the Texas Department of Public Safety (DPS). A CHRI check typically provides information on arrests, prosecutions, and the disposition of cases for individuals who were arrested for a class B misdemeanor or higher in Texas, including Cameron County.    

There are two ways to conduct a criminal history record information check through the DPS: a name-based check and a fingerprint-based check. Individuals may use the DPS’s Computerized Criminal History System (CCH) to conduct name-based checks online. They would need to log in or create an account to access the CCH. Furthermore, searches on the CCH cost one search credit, equivalent to $3, and additional fees may apply. Alternatively, record seekers may submit an offline request by completing the CR-42 form and mailing it to the DPS with a $10.00 fee.

Meanwhile, fingerprint-based checks may be conducted by visiting the DPS’s Fingerprint Applicant Services of Texas (FAST) locations to get fingerprinted. Note that visits are by appointment only. Individuals may schedule an appointment online or by calling 1-888-467-2080. They will be charged a $10.00 service fee for fingerprinting and $15.00 for the CHRI. It is worth noting that the DPS CR-63 form contains more instructions on conducting fingerprint-based checks. 

On the other hand, arrest information for individuals arrested in Cameron County but booked in state correctional facilities is available through the Texas Department of Criminal Justice (TDCJ) inmate information search portal. The portal is accessible for free and searchable by a subject’s name, TDCJ number, or SID number. Meanwhile, arrest information for those booked in federal correctional facilities may be found on the Federal Bureau of Prisons (BOP) inmate locator portal. Searches on the portal are free and may be conducted by name or number.

The Cameron County Jail Roster is a public service tool provided by the Cameron County Sheriff’s Office. It contains a list of individuals currently held in the Cameron County Jail or who were detained within the past seven (7) days. These include those awaiting bail or serving sentences for a crime. Active Warrant Search in Cameron County

Under Texas Code of Criminal Procedure § 15.01, an arrest warrant, also known as a warrant of arrest, is a written order issued by a magistrate that commands a peace officer or another named person to arrest an individual accused of committing an offense. The requisites for an arrest warrant in Cameron County to be legally valid include the following: 

  • It must be issued in the name of “the State of Texas.”
  • It must specify the name of the person to be arrested, if known, or some reasonably definite description of them. 
  • It must state the name of the alleged offense.
  • It must be signed by the issuing magistrate and contain the name of their office.

How to Find Arrest Records for Free in Cameron County

Interested individuals may find arrest records for free in Cameron by reviewing the county’s Jail Roster. The roster is accessible for free and searchable by subject name, booking number, booking date, SO number, and charges. Alternatively, record seekers may visit local law enforcement agencies, such as the Cameron County Sheriff’s Office or Municipal police departments, to inspect arrest records they generated and maintain in person. These agencies may permit free in-person inspection of records. However, requests for copies of records may incur certain fees.

Cameron County arrest reports are descriptive documents written from the perspective of an arresting officer that outline the sequence of events leading to an arrest and what occurred during and after the incident. The arresting officer is generally responsible for preparing an arrest report after they book an arrestee. 

In comparison, an arrest record is an official document that contains factual information about an arrest, including the arrestee’s personal information, charges levied against them, and the arrest date, time, and location. These documents are used in numerous official capacities, including being reported to the Texas Department of Public Safety (DPS) for its inclusion in a statewide criminal history record information (CHRI). 

How to Get an Arrest Record Expunged in Cameron County

In Cameron County, Texas, the Texas Code of Criminal Procedure Article 55A governs the process for expunction of arrest and other criminal records. The code also outlines arrest records that are eligible for expunction. These include, but are not limited to;

  • Arrests that resulted in no charges being filed
  • Arrests where criminal charges were dismissed
  • Arrests for certain qualifying misdemeanor juvenile offenses
  • Arrests that led to a minor’s conviction for certain alcohol offenses
  • Arrests that occurred as a result of identity theft
  • Arrests that resulted in a conviction that was later overturned by a trial court or a court of criminal appeals
  • Arrests that led to a conviction that was later pardoned by the governor of Texas or the U.S. president. 

Eligible individuals may complete the appropriate expungement forms and prepare the relevant fees. According to the Cameron County District Clerk’s fee schedule, applicants are charged a $350 fee for expunction requests. However, applicants who may not afford the applicable fee may fill out a statement of inability to afford payment of court costs and file it with their expungement petition. Applicants may file their completed expungement petition and other relevant documents online through the E-File Texas portal. Alternatively, they may file their expungement petition, other relevant documents, and pay the filing fee (if applicable) at the Cameron County District Clerk’s office at:

Subsequently, the applicant will be issued a case number and court number, and a hearing will be scheduled for their case. The applicant may fill out the appropriate order form, order granting expunction for one arrest, or order granting expunction for more than one arrest, and bring it on their hearing date. If their petition gets approved, the judge will sign the order. Afterward, the applicant must file the signed order form with the district clerk’s office to close their case.   

How Do You Remove Cameron County Arrest Records From the Internet?

Interested persons may get their arrest records removed from the internet through any of the following: 

  • Expunging an arrest record: This is the official way to protect one’s arrest record from public access. Eligible arrest records may be expunged pursuant to Texas Code of Criminal Procedure Article 55A. Once expunged, an arrest record will no longer appear in searches conducted through government-run channels, such as DPS’s Computerized Criminal History System (CCH). 
  • Filing an opt-out request: Generally, third-party websites that provide public records search services usually allow individuals to opt out of their services. Opting out essentially removes an individual's records from the website’s public records database. They typically provide an opt-out request form that individuals may complete and submit.
