Cameron County court records are documents generated and maintained by the county’s various trial-level courts and clerk’s offices, serving as a record of all legal proceedings within the county. Court records are kept in accordance with judicial rules and are generally public unless they contain sensitive information that has been sealed by the court or restricted by state law.

Court records are distinct from other public records maintained in the state, but often incorporate and interact with them. For example, the arrest record of an individual who was prosecuted may become a part of their court record.

Are Cameron County Court Records Public?

Yes. Court records are public in Cameron County. While many government records in Texas are covered by the Public Information Act, the judiciary is exempt from it. Instead, access to court records is governed by the common law right of access and several judicial rules (e.g., Rule 12 of the Rules of Judicial Administration and Rule 76a of the Rules of Civil Procedure).

Cameron County Court Records Search

Cameron County court records are accessible in the following ways.

  • Online Access

The primary online portal for court record searches in the county is the Texas Court Records Search portal. The portal provides access to records from the District, County Courts at Law, and Probate Court. Justice of the Peace and Municipal Court records are not accessible through the portal. Researchers generally have to contact those courts directly for their case records. Confidential court records are not available online.

  • In-Person Access

Individuals seeking access to a record not available online or who need a copy of a court record often have to obtain the record in person. Records of cases heard in the District Court are maintained by the District Clerk. Records from the County Courts at Law and Probate Court with the County Clerk. Justice of the Peace and Municipal Courts retain their own records.

Requesters can walk into the office of the custodian of the record they wish to inspect or obtain. Office staff will need a name or case number to locate the record, and a fee may be charged for the reproduction of the record.

  • Mail and Phone Requests

Mail requests are also possible in Cameron County, in addition to online and in-person access. To obtain a record by mail, individuals may submit a written request clearly describing the record they wish to access from the court. For District Court records, applicants may complete and mail the Copy Request Form to the District Clerk’s Office. Once the request has been processed and prepared, a requester can pick up the record in person or have it mailed back to them. Records not picked up in person within 10 days will require a new request and payment.

Fees for Court Records in Cameron County

Individuals requesting to inspect or obtain a copy of a court record from a custodian in Cameron County may be asked to pay a fee. The following fees generally apply to court record access in the county.

  • Plain copies: $1 per page
  • Certified copies: $5 per seal
  • Authenticated/Exemplified copies: $10 flat fee plus $1 per page
  • Record search (if case number is not provided): $5 per name
  • Electronic copies: $1 for the first 10 pages and 10 cents per page thereafter

Fees can be avoided by searching four court records through the Texas Court Records Search portal.

Fees for vital records maintained by the County Clerk include

  • Birth certificate: $23 per copy
  • Marriage certificate: $21 per copy
  • Death Certificate: $21.00 for the first copy and $4.00 for each other copy ordered at the same time

Criminal Records Access in Cameron County

Criminal records in Cameron County are maintained by law enforcement departments and the judiciary, based on the specific record. Law enforcement agencies keep records of an individual’s arrest, detention in jail, and prison time, while the court maintains all information relating to the individual’s trial.

The Texas Department of Public Safety (DPS) is the central repository for all criminal history information reported by local law enforcement and courts across Texas. The DPS is responsible for issuing certified criminal history reports. Individuals can obtain a report from the agency via a Criminal History Conviction Name Search or a Fingerprint-based search. Fingerprint searches, however, are not for public use.

Individuals may access criminal court files maintained by the court from the relevant Clerk’s Office holding the record. Public criminal court records may also be accessible on the Texas Court Records Search portal.

Cameron County Probate Records

Cameron County probate records are documents related to the administration of a deceased person’s estate, guardianships, and mental health cases. Probate records usually include a will (if available), asset inventories, small estate affidavits, probate applications, and court orders.

In Cameron County, probate cases are heard by the Probate Court, but the records are filed with the County Clerk’s Probate Department. Older records (some dating back to 1848) are stored at the Records Management Facility. Individuals can search for existing probate cases on the Texas Court Records Search portal. Probate records may also be accessed in person at the County Clerk’s Office or requested by mail.

Most probate records are public. For example, anyone can view a probated will or an estate’s inventory once filed with the court. However, certain probate records (e.g, mental health and guardianship records) are typically restricted to the public.

Cameron County Family Court Records

In Cameron County, family law cases such as divorces, child custody, adoptions, and child support are primarily handled by the District Courts. The County Clerk is the custodian of all family court records in the county and oversees access to them.

Individuals may access family court records by visiting the County Clerk’s Office. A search may also be done on the Texas Case Search Portal. However, online availability of family court records may be limited due to the confidentiality of certain documents.

Federal Court Records in Cameron County

Federal court records in Cameron County are managed by the Brownsville Division of the United States District Court for the Southern District of Texas. Unlike county court records, these files are handled through a centralized federal system.

The primary way to access federal court records in the county is the Public Access to Court Electronic Records (PACER).
